An Insight into the Role of the Independent Children’s Lawyer in Parenting Proceedings

On 6 June 2024, Legal Aid NSW hosted an Independent Children’s Lawyer Information Event in the Newcastle Registry of the Federal Circuit and Family Court of Australia.

This session provided information and insights into the role of the Independent Children’s Lawyer (ICL) for lawyers who are interested in completing the training necessary to undertake this important work.

The Honourable Judge Costigan spoke on the role of the Independent Children’s Lawyer before chairing an interactive panel session, with the panel comprised, Justice Austin of the Federal Circuit and Family Court of Australia, local barrister Ian Duane and three practising ICL’s, Luke Shearston, Carey Pearson and Kasey Matheson.

Luke Shearston of Gillard Family Lawyers appeared on the panel in his capacity as an ICL in a private firm.  He answered questions and offered his insights into the importance of the role, the challenges of the role, as well as the benefits and professional development that acting in this role can bring to a practitioner.

The session was well received by all those who attended and it is hoped that many of those attendees will complete the training to become accredited as ICL’s in the future.
